Terms of Service

§1. General Provisions

These Terms of Service define the rules for providing services by Nutrigen Sp. z o.o., located at ul. Tadeusza Kościuszki 25/5, 50-011 Wrocław, registered in KRS under number 0000851334, NIP: 8971881125, REGON: 386589960, hereinafter referred to as the "Service Provider".

Services are provided under the SiteGuard brand through the website stronabezwirusow.pl.

§2. Definitions

• Website – service available at https://stronabezwirusow.pl.
• Client – natural person, legal entity, or organizational unit using the Service Provider's services.
• Services – services for cleaning and securing infected websites (particularly WordPress-based), according to the offer presented on the Website.
• Order – request submitted by the Client through the website form, containing contact details, problem description, and selected service package.

§3. Scope of Services

The Service Provider offers paid services:

• removal of malicious software and code from infected websites;
• restoration of website functionality;
• securing the website against future attacks;
• installation and configuration of security tools;
• backup creation;
• (optionally) ongoing monitoring and technical support in the form of a subscription.

§4. Order Placement Rules

• Orders can be placed by the Client through the website form, without the need for prior account registration.
• When placing an order, a user account is created, with access granted through an activation email or login credentials sent to the Client's email address.
• Placing an order is equivalent to concluding a service agreement.
• Payment for the service is processed through the Tpay online payment operator, according to the price list visible at the time of order placement.
• Service implementation begins after payment is credited, unless otherwise agreed by the parties.

§5. Rights and Obligations of the Parties

• The Service Provider commits to due diligence in service implementation according to the selected package description.
• The Client is obliged to:
  • provide accurate contact details,
  • provide access to the website (admin panel / FTP / hosting) necessary for service implementation,
  • pay for the service using the selected method.
• The Service Provider is not responsible for:
  • problems resulting from hidden or complex infections exceeding the service scope;
  • consequences of previous lack of software updates or incorrect website configuration by the Client;
  • effects of unauthorized third-party interference during service provision.

§6. Implementation Time

• The service is implemented within 3 business days, counting from the moment of payment crediting and receipt of required access.
• In most cases, implementation occurs within 24h, but complex infections may extend this time – the Client will be informed via email.

§7. Complaints

• The Client has the right to file a complaint if the service was performed inconsistently with the description or if problems occur after the work is completed.
• Complaints should be submitted to: [email protected].
• The Service Provider considers complaints within 14 business days.
• The warranty covers removal of the same infection if it reoccurs within 30 days of service completion (applies only to services without subscription).

§8. Withdrawal from Agreement

• Due to the nature of the services, which begin immediately after payment is credited, the Client agrees to start service provision before the withdrawal period expires, which results in the loss of the right to withdraw under Article 38(1) of the Consumer Rights Act.
• If the service has not yet started, the Client may cancel the order by contacting the Service Provider.

§9. Personal Data

• The administrator of the Client's personal data is Nutrigen Sp. z o.o..
• Data is processed for service implementation, contact, and customer account management, in accordance with applicable GDPR regulations.
• Details regarding data processing are available in the Privacy Policy.

§10. Final Provisions

• The Service Provider reserves the right to change these Terms of Service. Changes take effect upon publication on the website.
• For matters not regulated herein, Polish law applies, particularly the Civil Code and the Act on Electronic Services.
